Please read these Terms & Conditions carefully before using our website or engaging JBMM Create’s services.
1. Acceptance of Terms
By using this website or engaging our services, you agree to be bound by these Terms & Conditions.
2. Services
JBMM Create provides custom website design and development, SaaS explainer video production, and digital creative products such as overlays and animations sold via Shopify.
3. Custom Project Terms
A 50% deposit is required before work begins. The remaining 50% is due upon completion and before final delivery of files. Project scope, timeline, and deliverables will be agreed upon during the consultation and outlined before work begins. Revisions beyond the agreed scope may incur additional charges, communicated before any extra work begins. Upon full payment, the client receives ownership of the final delivered files. JBMM Create retains the right to showcase completed work in our portfolio unless otherwise agreed in writing.
4. Digital Products
All digital product purchases are final. Due to the instant, downloadable nature of these products, we do not offer refunds once a file has been delivered or downloaded. Digital products are licensed, not sold. Each purchase covers use by the original purchaser on a single content channel or brand — for example one YouTube, Twitch, or TikTok channel. Licenses may not be shared, resold, redistributed, sublicensed, or used across multiple channels, brands, or accounts. Need coverage for more than one channel? Contact us and we’ll sort out a license that fits.
5. Client Responsiveness
Timely delivery depends on receiving feedback, content, and approvals when requested. If a client is unresponsive for 30 consecutive days, the project may be considered paused or closed at our discretion, and the deposit may be forfeited. Work can be resumed under a new timeline, subject to availability.
6. Cancellations
Custom project deposits are non-refundable once work has begun. If a project is cancelled before work begins, the deposit may be refunded at our discretion, minus any administrative costs already incurred.
7. Disclaimer of Warranties
Our services and website are provided “as is.” We make no warranties, express or implied, regarding the results of our services beyond what is explicitly agreed upon in a project scope.
8. Limitation of Liability
JBMM Create is not liable for any indirect, incidental, or consequential damages arising from the use of our services or website.
9. Governing Law
These Terms & Conditions are governed by the laws of the State of New York, without regard to conflict of law principles.
10. Changes to These Terms
We may update these Terms & Conditions at any time. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
